4.3.5 Looked After Reviews in Respect of Children Looked After by the Local Authority who are Subject of a Formal Child Protection Plan |
SCOPE OF THIS CHAPTER
This chapter was added to this manual in November 2011 and should be read in full.
- In most cases where a child who is the subject of a child protection plan becomes looked after, it is no longer necessary to maintain the child protection plan;
The child protection plan in these situations will be discontinued at the next child protection conference or if appropriate outside of a conference; in the latter situation, each agency will be informed of this decision by the Child Protection Co-ordinator. And given an opportunity to make representations if they do not agree with the decision; - There are relatively few cases where safeguarding issues remain and it is considered that a looked after child should also have a child protection plan. These cases are usually where the local authority has obtained an Interim Care Order in family proceedings but the child or young person subject of the child protection plan remains living at home or in a residential assessment placement with their parent(s), or where we are working under the "No Order" principle in family proceedings and the child is accommodated under Section 20 and placed with a family member;
- Where a looked after child remains the subject of a child protection plan, there will be an integrated planning and reviewing process;
- The systems and processes for reviewing children subject to CP plans and looked after have been carefully evaluated by the local authority, taking into consideration the current reviewing structures, specialist safeguarding and child protection expertise within the department and the need to assimilate that the child protection conference is required to be a multi-agency forum whilst children for the most part want as few external people as possible at a review meeting where they are present;
- In view of the impact upon families (and in some cases children) occasions when two separate meetings take place will be kept to a minimum;
- The Child Protection Co-ordinator and the Independent Reviewing Officer will consider with social work colleagues and take into account the family's views as to the most appropriate reviewing mechanism for each child;
- There will be an integrated planning and reviewing process which will include the Independent Reviewing Officer attending the review Child Protection Conference where this is appropriate;
- On those occasions where there are two separate meetings:
- The Child Care Review will consider the child's care plan;
- The Child Protection Conference will focus on the identification, analysis and management of ongoing risks to a child;
- Child Protection Conferences in relation to children subject to a CP plan and looked after will be chaired by the Child Protection Co-ordinators.
